These terms are between BuildFrame Technologies Private Limited, C-1208, ACE PLATINUM, ZETA 1, Greater Noida, Uttar Pradesh 201306, India ("we") and the business that opens an account ("you"). They took effect on 2026-09-12. Using the service means accepting them.
Shoppers who only use a try-on widget on someone's storefront are not party to this agreement — what applies to them is the Privacy Policy.
1. What the service is
GenFashion generates a synthetic image showing a garment on a person, from a photograph the shopper supplies. It is a visualisation aid.
It is not a fitting or sizing service. The result does not establish that a garment fits, and you must not present it to your shoppers as if it did. If you use it to make a size claim, that claim is yours.
2. Your account
You are responsible for what happens under your credentials, including the API keys you issue. A publishable key is public by design — it lives in your storefront's HTML — and is bounded by the origin allowlist you set on it. Keep secret keys server-side. Tell us promptly if a credential is exposed and we will revoke it.
3. Credits and payment
Try-ons are paid for with credits, bought in packs at the prices shown at checkout in your currency.
- A credit is charged only when a generation succeeds. A failed or refused try-on costs you nothing.
- One try-on is one credit, whatever the garment count in the outfit.
- Credits do not expire, and they have no cash value. Purchases are non-refundable except where law requires otherwise; if we bill you in error, tell us and we will fix it.
- Prices can change. A change never re-prices credits you already hold.
4. Fair use limits
The service applies per-shopper, per-account and platform-wide rate limits, and refusals are part of normal operation rather than a fault. The limits protect every shop on the deployment from any one of them. We may lower a limit for an account that is degrading the service for others, and will tell you when we do.
5. What you must do about shopper photographs
This is the clause that matters most, because you are the controller of those images and we are not.
You must:
- Obtain the shopper's consent before their photograph is uploaded. Our widget presents a consent control and will not open a file picker until it is ticked. Do not remove, hide or auto-tick it, and do not build an integration that skips it.
- Publish your own privacy notice covering try-on, and link it where your shoppers can find it.
- Not upload a photograph of anyone who has not agreed to it — including images of your own models or customers taken for another purpose.
- Not use the service for anyone under 18.
Some places — Illinois and Texas among them — treat a facial image as biometric data with its own written-consent rules and statutory penalties. Whether they apply to you is your assessment to make. We are telling you the rules exist, not advising you on them.
Because you are the controller and we are the processor, the processor-side commitments — what we do with a photograph, which sub-processors see it, how it is deleted, and how a subject request is answered — are in the Data Processing Agreement. It is a draft pending legal review and says so at the top.
6. Acceptable use
Do not use the service to produce sexual content, to depict a real person in a way they have not agreed to, to impersonate anyone, or to generate anything unlawful. Do not attempt to extract our prompts or resell raw model access. Automated screening refuses some of this before generation; the rest is on you, and breach is grounds for immediate suspension.
7. Rights in the images
You keep whatever rights you had in the garment images you supply. The shopper keeps the rights in their own photograph. As between us and you, the generated result is yours to use in the shopping session it was made for. We claim no ownership of it and, as stated in the Privacy Policy, we do not use any of it to train models.
8. Availability
We aim for the service to be up and do not promise that it is. There is no SLA on these terms. Generation depends on third-party AI providers, and their outages become ours. Maintenance, provider failures and rate limits can all interrupt service without notice.
9. Warranties and liability
The service is provided "as is", without warranty of any kind, including fitness for a particular purpose. To the fullest extent the law allows, our total liability arising out of these terms is limited to the amount you paid us in the twelve months before the claim, and we are not liable for lost profits, lost sales or indirect loss.
Nothing here limits liability that cannot lawfully be limited.
10. Suspension and termination
You may close your account at any time. We may suspend or close an account that breaches these terms, that we are legally required to close, or that is not paying. On closure, generation stops immediately, unused credits are forfeited unless the closure was our fault, and stored photographs are deleted on the retention schedule already in force.
11. Changes
We may change these terms. Material changes are posted here with a new date, and continuing to use the service after that is acceptance. If you do not accept, close the account.
12. Governing law
These terms are governed by the laws of India, and its courts have exclusive jurisdiction.
